  • This consultation seeks views on the design and implementation of the building safety levy, which will apply to certain new residential buildings requiring building control approval in England.

    The Building Safety Act 2022 introduced powers to impose a levy on certain new residential buildings in England, to raise revenue to be spent on building safety.

    ​The government carried out a consultation on the levy which closed on 7 February 2023. The results of that consultation have been published online. Feedback from that consultation was used to develop the proposals outlined in this consultation, which provides a greater level of detail on the operation of the levy. This consultation covers:

  • The Responsible Actors Scheme, as detailed by the Department for Levelling Up, Housing, and Communities, will limit developers sanctioned under this scheme to building sites of fewer than 10 homes, barring them from major developments in England, it has been announced. 

    The scheme recognizes and acknowledges efforts made by responsible developers to rectify life-critical fire safety issues in residential blocks they developed or refurbished over the past 30 years, with those joining the scheme committing to remediating numerous buildings, with non-compliant developers facing planning and building control sanctions such as the one to ban developments over 10 homes. The guidelines outline requirements for prohibited developers, necessitating them to notify authorities about their status and limiting their ability to obtain planning permission and building control approval for major developments. Exceptions apply for certain situations, such as emergency repairs and critical infrastructure projects.

  • On 3 July 2023, regulations to establish a Responsible Actors Scheme (RAS) for residential developers under sections 126-129 of the Building Safety Act 2022 were signed into law. On 21 July 2023, government launched the Responsible Actors Scheme.

    The Scheme will recognise action taken by responsible developers to identify and remediate or pay to remediate life-critical fire safety defects in residential buildings 11 metres or over in height which they developed or refurbished in England over the 30 years to 4 April 2022.

    Developers who are likely to be eligible to join the Scheme will receive an invitation from the Secretary of State. In order to join the Scheme, eligible developers will need to respond to the invitation, apply for membership and enter into the developer remediation contract.

    Those who successfully sign up to the Scheme will have their names added to the Responsible Actors Scheme members list.

    As of 21 September 2023, 37 developers have joined the Scheme.

    The developers who have joined the Responsible Actors Scheme have collectively committed to remediating over 1,100 buildings, equating to over 75,000 homes, at a cost to themselves of over £2 billion.
