The leaseholder protections under the BSA, together with the certificates regime, looking at:

  • Relevant buildings and identifying when a building is a relevant building for the purposes of the BSA
  • Qualifying leases at the qualifying time -  Relevant defects and relevant steps
  • Associated companies
  • The statutory waterfall under schedule 8
  • Landlord’s certificates
  • Leaseholder deeds of certificate

Where there are relevant defects and relevant steps to be undertaken, we will also explore remediation orders and remediation contribution orders, looking at:

  • What remediation orders and remediation contribution orders are and the differences between the two
  • Who can apply
  • What might be covered under a remediation contribution order
  • Recent decisions from the appeal courts.
