Changes to the Building Regulations have created new client duties with significant criminal penalties Although not yet tested in court, a Managing Agent may be considered a client under the Building Regulations and in any case they will need to undertake building work, on behalf of their client, so that it complies with all requirements of the law. Whether you are managing building your work or instructing a surveyor or other specialist to manage the work, a managing agent must understand what a client needs to do to comply with the law. The course will look at what is building work, the procedures that need to be followed when undertaking and the approvals that must be obtained with a focus on the clients duties.

Course Contents

Understanding the scope that the term “building work” covers is crucial in managing such works. It can mean:

  • Erecting or extending a building
  • Providing or extending a controlled service or fitting (for example, installing or reinstalling, boilers or heating or plumbing systems and undertaking electrical work within the common parts of flats);
  • Material alteration of a building, controlled service, or fitting (for example, replacing a fire door or installing or reinstalling services that run through a fire compartment wall );
  • Work required by a material change of use (when the purpose of the building changes, triggering compliance);
  • Inserting insulating material into a cavity wall;
  • Underpinning (strengthening the foundations) of a building;
  • Work required for a change in energy status or involving the renovation of thermal elements like roofs or external walls; and
  • Consequential improvements to energy performance in certain existing buildings.

We will focus on the role of the client in relation to planning, managing and monitoring a project including the statutory duty to ensure everybody appointed to design, manage or undertake work is competent.

We will also cover the procedures to be following where a property is not a higher-risk building [HRB] and also the additional procedures (the Gateways) to be followed where it is an HRB.
