The introduction of the Building Safety Act 2022 introduces new responsibilities and accountabilities on owners and managers of high-rise residential properties. Understanding who is accountable and what is needed is essential for owners and managers alike in order to stay ahead of the game and understand what it is going to take to ensure compliance.
Owners, known as Accountable (AP) or Principal Accountable Persons (PAP) will be required to develop a formal “Building Safety Case Report” to assure themselves along with others including the Residents, the new Building Safety Regulator (BSR) and other enforcers that the property has not only been designed and built safely but is managed safely now and in the future. The development of this document will have to rely upon managing agents due to the nature of the information and arrangements that are required.
Failure to get this report right will not only affect the building and its occupants – the report forms part of the documentation that has to be submitted to the BSR as part of the Building Assessment Certification process for approval to allow continued occupancy of the building – but moreover, the fees that will be applied by the BSR when AP/PAP’s are required to apply for Certification will be based on how well the Safety Case Report and the associated technology have been developed.
A Building Safety Case report has been described by the BSR as one of the most important new documents that will be needed to be developed in the new building safety regime and requires the right levels of competence in not only fire safety but also structural safety in order to develop them.
The aim of this course is to help you, your team and your clients understand who has accountability for the development of a Building Safety Case Report but also understand what is required, what support can be offered to AP/PAPs and how best to manage building safety in the long term.
